Foul Ball Injury at Fenway Park
Brittany helped represent a spectator who suffered serious injuries after being struck by a foul ball while seated in an unprotected section of Fenway Park. When the Boston Red Sox argued that longstanding baseball law effectively shielded the organization from liability, Brittany and the litigation team challenged that position.
The case survived efforts to have it dismissed, including summary judgment, allowing the plaintiff to pursue the claim that the Red Sox owed a legal duty to protect spectators from unreasonably dangerous foul balls in certain areas of the stadium.
The case illustrates the kind of litigation Brittany embraces: challenging established defenses, taking on powerful institutions, and pushing for accountability where the law and the facts demand it.
Unsafe Stairway Premises Liability Case
Brittany served as counsel for a woman seriously injured because of a hazardous condition on a landlord’s property. The client tripped over an extension cord dangerously positioned on the stairway, causing her to fall and fracture her foot.
Rather than accept the defense’s position that the property owner was not responsible, Brittany helped take the case to trial. The defense settled the case during trial.
Civil Rights & Government Accountability
Brittany represents individuals whose constitutional rights have been violated by government entities, correctional institutions, and public officials. Her civil rights practice includes claims arising under the Fourth, Eighth, and Fourteenth Amendments, including cases involving excessive force, cruel and unusual punishment, deliberate indifference, and other abuses of governmental authority.
In one significant case, Brittany successfully represented an incarcerated individual who suffered permanent paralysis after correctional officials failed to respond appropriately to a serious medical emergency. While incarcerated and experiencing acute withdrawal and detoxification, her client fell and fractured his back. Despite his condition and serious injuries, he was forced to walk to an investigative interview. His injuries ultimately resulted in permanent paralysis.
Brittany pursued claims arising from the violation of her client’s constitutional right to be free from cruel and unusual punishment and successfully secured a settlement on his behalf.
Cases involving governmental misconduct present some of the most difficult challenges in civil litigation. Government defendants often invoke immunity and other substantial legal protections before a jury ever has an opportunity to hear what happened. Brittany’s experience includes confronting those defenses and developing the factual and legal record necessary to hold governmental actors accountable.
For Brittany, constitutional protections have meaning only when they can be enforced. A person’s loss of liberty does not mean the loss of the fundamental right to be treated humanely.
